This Privacy Policy (“Policy”) explains how we collect, use, disclose, and protect your information when you access or use farmlabel.app (the “Service”).

The Service is operated by farmlabel.app LLC, an Illinois limited liability company organized under the laws of the State of Illinois, United States, with its registered address at 16018 IL Route 176 Union, IL 60180-9738, Illinois, USA (“we,” “us,” or “our”).

1. Scope and Roles under Global Privacy Laws

Different privacy regulations (such as the General Data Protection Regulation (“GDPR”), the UK GDPR, and the California Consumer Privacy Act (“CCPA/CPRA”)) classify entities based on how they control and process information. Under these laws, our operational roles are defined as follows:

  • We Act as Data Controller for the personal information we collect directly to manage your user account, verify eligibility, process subscription payments, correspond with you, and run analytical performance metrics of our application.
  • We Act as Data Processor for the customer-owned operational and harvest metrics (such as lot numbers, dates, crop descriptions, and traceability records) pulled from your authorized Google Sheets spreadsheets. Your business remains the Data Controller of this "Customer Data," and we process it strictly on your instructions and in accordance with the terms of our active agreements and our standard Data Processing Agreement (DPA).

2. Information We Collect and California Disclosures

The table below summarizes the categories of personal data we have collected or processed within the preceding twelve (12) months. This is formulated to satisfy our disclosure obligations to California consumers, business accounts, and other regional users:

CCPA Category Specific Types of Information Collected Sources

Commercial Information Payment records, Label Pack transaction logs, subscription status, and billing details (handled by secure payment processors). Generated through transactional interactions with our subscription engine.
Internet or Network Activity Browser information, device details, server logging, and page performance telemetry. Automatically collected via application access logs.

No Selling or Sharing: We do not "sell" your personal information, nor do we "share" your personal information with third parties for cross-context behavioral advertising campaigns (as defined under the CCPA/CPRA).

3. Legal Bases for Processing (EEA, UK, and Swiss Users)

If you access the Service from the European Economic Area (EEA), the United Kingdom (UK), or Switzerland, we must process your personal information under a recognized legal basis under Article 6 of the GDPR. We process your data under the following conditions:

Processing Purpose GDPR Legal Basis

Processing payments for Enterprise subscriptions or Prepaid Label Packs. Performance of a Contract (Article 6(1)(b)) — Required to complete payment transactions and maintain your credits.

4. Google API Integration and Limited Use Compliance

Our Service relies on direct API access to your designated Google Sheets files to build crop barcodes and traceability labels. Our handling of your Google data is subject to rigorous protections:

  • Strict Scope: We only read data from the specific spreadsheets you actively select for formatting. We never edit, rewrite, or delete your source file contents.
  • Limited Use Adherence: Our use and transfer of information received from Google APIs to any other app will adhere to the Google API Services User Data Policy, including its "Limited Use" requirements.
  • No Unauthorized Disclosures: We never share Google Sheet contents with third-party ad networks, marketing services, or data brokers. No staff members read your raw spreadsheet inputs unless you initiate a technical support request and grant us express permission to review a specific file for troubleshooting.

5. Cookie Classifications and Tracking

We use cookies and equivalent tracking technologies to run the Service. These are categorised as follows:

  • Essential Cookies: Strictly necessary to run the core application. These cookies manage secure login sessions, user authentication, and system configurations. The Service cannot operate without these files.
  • Analytics Cookies: Utilized to track aggregated user flow, pinpoint page errors, and measure user engagement (such as page speed bottlenecks). We use privacy-compliant, anonymized telemetry tracking to monitor our system health. If we utilize standard third-party analytic solutions, your identifiable variables remain protected or anonymized.
  • Functional/Preference Cookies: Remember custom preference layouts, such as default labeling dimensions, so you do not have to reconfigure them upon logging in.

You can adjust your personal browser settings to reject or delete cookies, though doing so may prevent you from logging into your account or retaining layout specifications.

6. Information Sharing, Subprocessors, and International Transfers

We share personal data with trusted third-party subprocessors who manage backend business infrastructure. Our vendor categories include:

  • Infrastructure Hosting: Secured cloud infrastructure providers to host our software and databases.
  • Payment Gateways: PCI-compliant organizations that securely handle your payment transactions.
  • Email Delivery Networks: Secure automated mailing engines to deliver transactional records, verification codes, and invoices.
  • Application Monitoring Services: Software utility services that collect system error diagnostics.

A current list of specific subprocessors utilized by farmlabel.app LLC is available to active customers upon request by contacting us at hello@farmlabel.app.

International Data Transfers: Our servers are located primarily within the United States. If you reside in the EEA, UK, or Switzerland, your data will be transferred out of your home region to the US. Where required by applicable law, such international transfers are protected through Standard Contractual Clauses (SCCs) approved by the European Commission, or other legally recognized transfer structures, to ensure your information receives equivalent legal safeguards.

7. Your Rights, Data Deletion Boundaries, and Complaints

Under global data privacy regulations, you have several rights regarding your personal information, including the right to request access, correction, portability, and restriction of processing. If you wish to request deletion of your account and personal details, please contact us at hello@farmlabel.app.

Limitations on Deletion Requests: While we honor valid deletion requests, we cannot provide absolute or immediate erasure of all billing and activity logs. We will delete or anonymize personal data except where continued retention is necessary to comply with legal tax obligations, financial audits, security protections, fraud prevention records, active business dispute resolutions, or food traceability regulatory recordkeeping (such as FDA FSMA 204 requirements).

Lodging a Complaint: If you reside in the EEA or UK, you have the right to lodge a complaint with your local data protection supervisory authority regarding our data processing methods.

8. Security and Incident Notification

We are dedicated to safeguarding your business records. We maintain industry-standard technical and organizational safeguards designed to protect personal and business information. These protocols include encryption of data in transit (utilizing HTTPS/TLS protocols) and encryption at rest where technically appropriate. If we become aware of an actual security incident or unauthorized data breach affecting your personal data, we will notify affected users and appropriate regulatory authorities as required under applicable law.

9. B2B Focus and Children's Privacy

The Service is intended strictly for commercial business users, growers, and agricultural enterprises, and is not directed to children. We do not knowingly collect personal details from individuals under the age of 18.

10. Policy Changes

We may update this Policy from time to time. If we make material modifications to these provisions, we will notify you by emailing the address on file or posting a prominent banner on our website. Material changes will become effective no earlier than thirty (30) days after notification. Non-material changes (such as typo fixes, minor phrasing updates, or contact directory updates) and updates required immediately for security or legal compliance will become effective immediately upon publication.
